Welcome to Server Owner Tycoon. These Terms & Conditions ("Terms") govern your access to and use of the Server Owner Tycoon website (the "Site"), the Server Owner Tycoon game (the "Game"), and any related services, content, or communities we operate (together, the "Services"). The Services are provided by Jordan Soffer, operating as Server Owner Tycoon, based in the Commonwealth of Massachusetts, United States ("we," "us," or "our"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
You must be at least 13 years old to use the Services. If you are under the age of majority in your jurisdiction, you may only use the Services with the involvement and consent of a parent or legal guardian. By using the Services, you represent that you meet these requirements.
Server Owner Tycoon is distributed through third-party platforms such as Steam. Your use of the Game through any such platform is also subject to that platform's own terms and policies. We are not responsible for the practices of third-party platforms, and purchases made through them are governed by that platform's refund and payment rules.
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to access and use the Services for your own non-commercial entertainment. You may not copy, modify, distribute, sell, reverse-engineer, or create derivative works from the Game or Site except as expressly permitted by law.
Some features (such as our newsletter, Discord community, or in-game accounts) may require you to register or provide information. You are responsible for keeping your credentials secure and for all activity under your account. When participating in our Discord or other community spaces, you agree to follow the rules posted there and to treat other members with respect.
You agree not to: (a) use the Services for any unlawful purpose; (b) harass, abuse, or harm other users; (c) attempt to gain unauthorized access to our systems or other users' accounts; (d) introduce malware or disrupt the Services; (e) cheat, exploit bugs for unfair advantage, or use unauthorized third-party software to modify the Game; or (f) scrape, data-mine, or use automated tools against the Services without our written permission.
The Game may offer virtual goods, in-game currency, or other purchasable items. These have no real-world monetary value, are licensed (not sold) to you, and are non-transferable and non-refundable except where required by law or by the platform through which you purchased them. We may change, manage, or remove virtual items at any time.
All content in the Services — including the Game, artwork, logos, characters, text, software, and the Server Owner Tycoon name and branding — is owned by us or our licensors and is protected by copyright, trademark, and other laws. Nothing in these Terms transfers any ownership rights to you.
If you submit content to us or our communities (feedback, suggestions, posts, or media), you grant us a worldwide, royalty-free, perpetual license to use, display, and incorporate it in connection with the Services. You are responsible for the content you submit and confirm you have the right to share it.
The Services are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Services. Our total liability for any claim relating to the Services will not exceed the greater of the amount you paid us in the twelve months before the claim or USD $100.
You agree to indemnify and hold harmless Jordan Soffer and Server Owner Tycoon from any claims, damages, or expenses (including reasonable legal fees) arising from your misuse of the Services or your violation of these Terms.
We may modify, suspend, or discontinue any part of the Services at any time. We may also update these Terms from time to time; the "Last updated" date above reflects the latest version. Continued use of the Services after changes take effect means you accept the updated Terms.
We may suspend or terminate your access to the Services at any time if you violate these Terms or for any other reasonable cause. Provisions that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will continue to apply.
These Terms are governed by the laws of the Commonwealth of Massachusetts, United States of America, without regard to its conflict-of-laws principles. You agree that any dispute arising from the Services will be resolved exclusively in the state or federal courts located in Massachusetts, and you consent to their jurisdiction.
